Kuwaiti Cassation Court dismissed Kamal Mustafa Sultan’s cassation request on April 20, 2010 in Case number 1243/2007 filed by Kamal Mustafa Sultan Company against The Public Warehousing Company and others.

Kindly note that the Kuwaiti Cassation Court ruled in a hearing held on April 20, 2010 to dismiss the aforementioned cassation request. Thus, the mutual waiver of the partnership agreement between Kamal Mustafa Sultan Company and The Public Warehousing Company has been finally and irrevocably confirmed and ratified by the cassation court’s judgment. Said Court has finally ruled that there are no grounds for any alleged financial rights for Kamal Mustafa Sultan Company in relation to the prime vendor contracts entered into between The Public Warehousing Company and the US Defense Supply Center Philadelphia.

We notify you of the above for you to take the measures that you deem appropriate and to clarify to the shareholders that the dispute has been finally closed, in favor of The Public Warehousing Company without prejudice to the rights of the company.
